This U.S. Consumer Privacy Notice (“Notice”) is provided on behalf of Seagate Technology LLC and any of its affiliates, (collectively, “Seagate” or “we” or “us”) and provides supplemental information on Seagate's collection, use and disclosure of Personal Information and the rights available to certain U.S. residents. If you reside in California, Colorado, Connecticut, Montana, Oregon, Texas, Utah, or Virginia, this page applies to you and supplements Seagate's Statement. Please click on your state of residence below to find out more about your rights and our collection, use, and disclosure of your Personal Information.

Capitalized terms used in this Notice that are not otherwise defined in this Notice are as defined in the Statement.

Please note that this Notice does not apply in situations where we collect Personal Information about our job applicants, employees, contractors, owners, directors, or officers as it relates to their current, former, or potential role at Seagate.

Collection of Personal Information

We collect certain "personal information" from consumers. “Personal information” is information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.  We refer to such information as "Personal Information" throughout this Notice.

Personal Information does not include:

• Publicly available information from government records or information that has lawfully been made available to the general public by the consumer or from widely distributed media;
  
• De-identified or aggregated information;
• Information excluded from the scope of applicable state law, such as:
  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and relevant state laws such as the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
  • Personal information that is covered by certain other privacy laws, like the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) and relevant state laws such as the California Financial Information Privacy Act (FIPA).

We collect Personal Information from our interactions with you. For example, when you contact us via our Site or on the phone, respond to a survey, or register a Seagate product. We also collect Personal Information from other sources, for example when public databases and joint marketing partners share the information with us, in accordance with applicable law.

We may have collected within the last 12 months the following categories of Personal Information:

• Identifiers, such as your name, telephone number, postal address, email address, user account name, and IP address;
• Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), such as your contact information and profile picture;
• Commercial information, such as transaction information and purchase history;
• Internet or network activity information, such as your browsing history and interactions with our Site;
• Geolocation data, such as your approximate location based on your IP address;
• Audio, electronic, visual, and similar information, such as call recordings;
• Professional or employment-related information, such as your title or industry;
• Your account log-in in combination with the password or credentials to access the account (if you have an account with us), which may be considered sensitive personal information under the California Privacy Rights Act (CPRA); and
• Inferences drawn from any of the above Personal Information to create a summary about you, for example of your preferences and characteristics.

Sources of Personal Information

We may obtain the categories of Personal Information listed above from the following categories of sources:

• Directly from you – for example, from forms you complete on our Site or when you contact us;
• Indirectly from you – for example, from your device when you access our Site or Offerings or from observing your actions on our Site or Offerings;
• From third parties that assist us in providing relevant services for our Site or Offerings;
• From joint marketing partners that share the information with us; and
• From public sources (such as public records).

Use of Personal Information

We may use your Personal Information described in this Notice to operate, manage, and maintain our business, to provide our Site and Offerings, for our vendor management purposes, and to accomplish our business purposes and objectives. For example, we may use your Personal Information to:

• Perform the services or provide the goods you request;
• Create, maintain, customize, and secure your account with us;
• Provide customer service and support, including investigating your concerns, responding to your requests, and monitoring and improving our responses;
• Develop, improve, repair, and maintain our Site and Offerings;
• Personalize, advertise, and market our products and services;
• Conduct research and data analysis;
• Undertake activities to verify or maintain the quality of our Site and Offerings and to improve, upgrade, or enhance our Site and Offerings;
• Conduct risk and security control and monitoring to maintain the safety, security, and integrity of our Sites, Offerings, databases and other technology assets, and business;
• Detect and prevent fraud;
• Perform identity verification;
• Perform accounting, audit, and other internal functions, such as internal investigations;
• Comply with law, legal process, and internal policies;
• Respond to law enforcement requests and as required by applicable law, court order, or governmental regulations;
• Maintain records;
• Exercise and defend legal claims; and
• Evaluate or conduct dissolution, divestiture, restructuring, reorganization, merger, or other sale or transfer of some or all our assets, including as part of bankruptcy, liquidation, or similar proceedings.

We may collect and process the sensitive personal information described in this Notice to:

• Perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services;
• Help ensure the security and integrity of our Site and Offerings;
• Perform services on behalf of our business, including to maintain or service accounts, provide customer service, process or fulfill orders and transactions, verify customer information, process payments, provide analytic services, provide storage, or provide similar services; and
• Undertake activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.
  

Retention of Personal Information

We will retain your Personal Information for as long as needed or permitted in light of the purpose(s) for which it was obtained.

The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and to provide the Site or Offerings to you (for example, for as long as you have an account with us or keep using the Site or Offerings); (ii) whether there is a legal or business obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations regulatory investigations, or other legal matters).

Disclosures of Personal Information

In the past 12 months, we may have disclosed the above categories of Personal Information to third parties, such as our service providers and affiliates, for our operational business purposes, as described in the Statement.

Third parties with whom we may share Personal Information include:

• Affiliates and Subsidiaries: We may share Personal Information with our affiliates and subsidiaries for our operational business purposes.
• Service Providers: We may share Personal Information with service providers, such as for technical or customer support, web or data hosting, payment processing, billing, accounting, analytics, auditing, legal consultancy, security, marketing, or otherwise developing, maintaining, and improving our business, our Site, and our Offerings.
• Parties Involved with Business Transfers: We may share Personal Information to third parties in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution or liquidation).

When we disclose Personal Information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except fulfilling the contract.

Sales and Sharing of Personal Information

We do not "sell" Personal Information for monetary consideration.

Like many websites, our Site uses cookies and other tracking technologies to provide you with a more personalized experience and targeted advertising, if you choose to enable such cookies. These cookies may be considered 'sharing' of Personal Information under certain state laws. These cookies are disabled by default and require your permission before they are enabled. If you choose to enable such cookies, we and our partners will use cookies as instructed by you to deliver and measure the effectiveness of ads, display personalized ads and content based on your interests (depending on your settings) and improve our products and services. Categories of Personal Information that may be shared (if you choose to enable such cookies) are identifiers and Internet or other similar network activity. Categories of third parties to whom Personal Information may be shared (if you choose to enable such cookies) are data analytics providers, social media, advertising and marketing providers. We do not sell or share Personal Information of individuals who we know are under 16 years of age, nor do we sell or share "sensitive personal information" as defined by applicable law.

California Privacy Rights

If you are a California resident, you may have the following rights under the Consumer Privacy Act, Cal. Civ. Code § 1798.100 et seq. (“CCPA”) and its implementing regulations, as modified by the California Privacy Rights Act (“CPRA”), subject to certain limitations and exceptions under applicable law:

• Access: You have the right to request access to the Personal Information that we may collect or retain about you. You also have the right to receive your Personal Information in a structured and commonly used format.
• Information: You have the right to request that we disclose to you, the following information covering the 12 months preceding your request:
  • The categories of sources from which the business collected Personal Information about you;
  • The categories of Personal Information collected; The business or commercial purpose for collecting Personal Information about you;
  • The categories of information that the business sells or discloses to third parties;
  • The categories of third parties with whom the business discloses Personal Information about you; and
  • The specific pieces of Personal Information the business has collected about you.
• Deletion: You have the right to request that we delete any of your Personal Information that we collected from you and retained.
• Correction: You have the right to request that we correct any of your Personal Information that we collected from you that is inaccurate.
• Opt-Out of Sales and Sharing: You may request that a business not sell or share your Personal Information with a third party. As described in the section "Sales and Sharing of Personal Information" above, we do not “sell” Personal Information. We do process Personal Information for the purpose of displaying targeted advertisements if you instruct us to do so, which could be deemed "sharing" of Personal Information for “cross-context behavioral advertising” under California law. You have the right to opt out of such sharing of Personal Information. You may modify your cookies choices at any time by clicking the ‘Cookies Settings’ link in the footer of our website.
• Limit the Use and Disclosure of Your Sensitive Personal Information: We do not use or disclose "sensitive personal information,” as defined by the CPRA, other than as described in the Section "Use of Personal Information" above or as otherwise permitted under applicable privacy law. Seagate does not process information that is subject to this limitation, nor does Seagate use such information to infer characteristics about you. As a result, we do not offer an ability to limit the use of sensitive personal information. 

You have the right to be free from unlawful discrimination for exercising your rights under the CCPA and CPRA. We will not discriminate against you for exercising any of your CCPA or CPRA rights.

California’s “Shine the Light” law (Civil Code Section § 1798.83) also permits California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. We do not disclose Personal Information to third parties for their direct marketing purposes.

Please note that the rights described above are not absolute, and where an exception under applicable law applies, we may be entitled to refuse requests in whole or in part. For example, where responding to your request involves disproportionate effort, when we are unable to verify your identity or if the rights and freedoms of another individual would be negatively affected. As a California consumer, you may exercise your consumer rights, free of charge, once for each customer in a 12-month period.

Colorado Privacy Rights

The Colorado Privacy Act and its implementing regulations define "consumer" as a Colorado resident who is acting in an individual or household context only and does not include residents acting in a commercial or employment context.

If you are a Colorado consumer, you may have the following rights concerning your Personal Information, subject to certain limitations and exceptions under applicable law:

• Access: You have the right to submit a verifiable consumer request to confirm whether we are processing Personal Information about you and to access such Personal Information.    
• Data Portability: You have the right to submit a verifiable consumer request to obtain your Personal Information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.
• Correction: You have the right to submit a verifiable consumer request to correct inaccuracies in the Personal Information we have collected about you, taking into account the nature of the Personal Information and the purposes of processing your Personal Information.
• Deletion: You have the right to submit a verifiable consumer request to delete your Personal Information.
• Opt-out of Data Processing for purposes of Targeted Advertising; Sales to Third Parties; and Profiling: As described in the section "Sales and Sharing of Personal Information" above, we do not sell Personal Information to third parties, or process Personal Information for the purpose of profiling in connection with decisions that produce legal or similarly significant effects. As described in the section "Sales and Sharing of Personal Information" above, we do process Personal Information for the purpose of displaying targeted advertisements, if you instruct us to do so. You have the right to opt out of the processing of Personal Information for targeted advertising purposes. You may modify your cookies choices at any time by clicking the ‘Cookies Settings’ link in the footer of our website.
• Appeal: You have the right to appeal a refusal to take action on your request. If you would like to appeal a refusal to take action on your request, please submit your appeal here by selecting the “Appeal” option and providing the request ID number of the request you would like to appeal. You must ask us to reconsider our decision within 45 days after we send you our decision. We will endeavor to respond to your appeal within 60 days of such an appeal, including a written explanation of the reasons for the decision, and any action taken or not taken in response to the appeal.

Please note that the rights described above are not absolute, and where an exception under applicable law applies, we may be entitled to refuse requests in whole or in part. For example, we may deny your request when we are unable to verify your identity or if the rights and freedoms of another individual would be negatively affected. As a Colorado consumer, you may exercise your consumer rights, free of charge, once for each customer in a 12-month period.

Connecticut Privacy Rights

The Connecticut Data Privacy Act defines "consumer" as an individual who is a resident of Connecticut. If you are a Connecticut consumer, you may have the following rights concerning your Personal Information, subject to certain limitations and exceptions under applicable law:

• Access: You have the right to submit a verifiable consumer request to confirm whether we are processing Personal Information about you, and to access such Personal Information, unless such confirmation or access would require the controller to reveal a trade secret.
• Data Portability: You have the right to submit a verifiable consumer request to obtain a copy of your Personal Information in a portable and readily usable format to the extent technically feasible and provided we will not be required to reveal any trade secret.
• Correction: You have the right to submit a verifiable consumer request to correct inaccuracies in your Personal Information.
• Deletion: You have the right to submit a verifiable consumer request to delete the Personal Information provided by you or obtained about you.
• Opt-out of Data Processing for purposes of Targeted Advertising; Sales to Third Parties; and Profiling: We do not sell Personal Information to third parties, or process Personal Information for the purpose of profiling in connection with decisions that produce legal or similarly significant effects. As described in the section "Sales and Sharing of Personal Information" above, we do process Personal Information for the purpose of displaying targeted advertisements, if you instruct us to do so. You have the right to opt out of the processing of Personal Information for targeted advertising purposes. • Appeal: You have the right to appeal a refusal to take action on your request. Montana Privacy Rights

The Montana Consumer Data Privacy Act defines "consumer" as a Montana resident but does not include a resident acting in a commercial or employment context. 

If you are a Montana consumer, you may have the following rights concerning your Personal Information, subject to certain limitations and exceptions under applicable law: 

• Access: You have the right to submit a verifiable consumer request to confirm whether or not we are processing your Personal Information and to access such Personal Information, unless such confirmation or access would require us to reveal a trade secret.
• Data Portability: You have the right to submit a verifiable consumer request to obtain a copy of the Personal Information you provided to us in a portable, and to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance, where the processing is carried out by automated means and provided that we are not required to reveal any trade secret.
• Correction: You have the right to submit a verifiable consumer request to correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and the purposes of the processing of the consumer's Personal Information.
• Deletion: You have the right to submit a verifiable consumer request to delete the Personal Information about you.
• Opt-out of Data Processing for purposes of Targeted Advertising; Sales to Third Parties; and Profiling: We do not sell Personal Information to third parties, or process Personal Information for the purpose of profiling in connection with automated decisions that produce legal or similarly significant effects. As described in the section "Sales and Sharing of Personal Information" above, we do process Personal Information for the purpose of displaying targeted advertisements, if you instruct us to do so. You have the right to opt out of the processing of Personal Information for targeted advertising purposes. • Appeal: You have the right to appeal a refusal to take action on your request. As a Montana consumer, you may exercise your consumer rights, free of charge, once for each customer in a 12-month period. If the request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee to cover administrative costs of complying with your request or may decline to act on the request.

You have the right to be free from unlawful discrimination for exercising your rights under the Montana Consumer Data Privacy Act. We will not discriminate against you for exercising any of your Montana Consumer Data Privacy Act rights.

Oregon Privacy Rights

The Oregon Consumer Privacy Act defines "consumer" as an Oregon resident who is acting in any capacity other than in a commercial or employment context. 

If you are an Oregon consumer, you may have the following rights concerning your Personal Information, subject to certain limitations and exceptions under applicable law: 

• Access: You have the right to submit a verifiable consumer request to confirm whether or not we are processing your Personal Information and to access such Personal Information.
• Data Portability: You have the right to submit a verifiable consumer request to obtain a copy of the Personal Information you provided to us in a portable, and to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance, where the processing is carried out by automated means.
• Correction: You have the right to submit a verifiable consumer request to correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and the purposes of the processing of the consumer's Personal Information.
• Deletion: You have the right to submit a verifiable consumer request to delete the Personal Information about you, including Personal Information that you provided to us, Personal Information that we obtained from another source, and derived data.
• Opt-out of Data Processing for purposes of Targeted Advertising; Sales to Third Parties; and Profiling: We do not sell Personal Information to third parties, or process Personal Information for the purpose of profiling in connection with decisions that produce legal or similarly significant effects. As described in the section "Sales and Sharing of Personal Information" above, we do process Personal Information for the purpose of displaying targeted advertisements, if you instruct us to do so. You have the right to opt out of the processing of Personal Information for targeted advertising purposes. You may modify your cookies choices at any time by clicking the ‘Cookies Settings’ link in the footer of our website.
• Appeal: You have the right to appeal a refusal to take action on your request. If you would like to appeal a refusal to take action on your request, please submit your appeal here by selecting the “Appeal” option and providing the request ID number of the request you would like to appeal. For example, we may deny your request when we are unable to verify your identity or if the rights and freedoms of another individual would be negatively affected. As an Oregon consumer, you may exercise your consumer rights, free of charge, once for each customer in a 12-month period. If the request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee to cover administrative costs of complying with your request or may decline to act on the request.

You have the right to be free from unlawful discrimination for exercising your rights under the Oregon Consumer Privacy Act. We will not discriminate against you for exercising any of your Oregon Consumer Privacy Act rights.

Texas Privacy Rights

The Texas Data Privacy and Security Act defines "consumer" as a Texas resident who is acting in an individual or household context but does not include a resident acting in a commercial or employment context. 

If you are a Texas consumer, you may have the following rights concerning your Personal Information, subject to certain limitations and exceptions under applicable law: 

• Access: You have the right to submit a verifiable consumer request to confirm whether or not we are processing your Personal Information and to access such Personal Information.
• Data Portability: You have the right to submit a verifiable consumer request to obtain a copy of the Personal Information you provided to us in a portable, and to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance
• Correction: You have the right to submit a verifiable consumer request to correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and the purposes of the processing of the consumer's Personal Information.
• Deletion: You have the right to submit a verifiable consumer request to delete the Personal Information provided by or obtained about you.
• Opt-out of Data Processing for purposes of Targeted Advertising; Sales to Third Parties; and Profiling: We do not sell Personal Information to third parties, or process Personal Information for the purpose of profiling in connection with decisions that produce legal or similarly significant effects. As described in the section "Sales and Sharing of Personal Information" above, we do process Personal Information for the purpose of displaying targeted advertisements, if you instruct us to do so. You have the right to opt out of the processing of Personal Information for targeted advertising purposes. You may modify your cookies choices at any time by clicking the ‘Cookies Settings’ link in the footer of our website.
• Appeal: You have the right to appeal a refusal to take action on your request. If you would like to appeal a refusal to take action on your request, please submit your appeal here by selecting the “Appeal” option and providing the request ID number of the request you would like to appeal. You must ask us to reconsider our decision within 60 days after we send you our decision. We will endeavor to respond to your appeal request within 60 days of receiving such an appeal, including a written explanation of the reasons for the decision, and any action taken or not taken in response to the appeal.

Please note that the rights described above are not absolute, and where an exception under applicable law applies, we may be entitled to refuse requests in whole or in part. For example, we may deny your request when we are unable to verify your identity or if the rights and freedoms of another individual would be negatively affected. As a Texas consumer, you may exercise your consumer rights, free of charge, twice for each customer in a 12-month period. If the request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee to cover administrative costs of complying with your request or may decline to act on the request.

You have the right to be free from unlawful discrimination for exercising your rights under the Texas Data Privacy and Security Act. We will not discriminate against you for exercising any of your Texas Data Privacy and Security Act rights. In addition to the methods for submitting a rights requests described in the ‘Making Rights Requests’ section below, you may also submit your rights request by email to data.protection.officer@seagate.com.

Utah Privacy Rights

The Utah Consumer Privacy Act defines “consumer” as an individual who is a resident of Utah acting in an individual or household context but does not include individuals acting in an employment or commercial capacity. If you are a Utah consumer, you may have the following rights concerning your Personal Information, subject to certain limitations and exceptions under applicable law: 

• Access: You have the right to submit a verifiable consumer request to confirm whether we are processing Personal Information about you, and to access such Personal Information.
• Data Portability: You have the right to submit a verifiable consumer request to obtain a copy of your Personal Information in a portable and readily usable format to the extent it is feasible, portable, practical and usable, and which allows you to transmit the data to another controller.
• Deletion: You have the right to submit a verifiable consumer request to delete the Personal Information you have provided to us.
• Opt-out of Data Processing for purposes of Targeted Advertising and Sales to Third Parties: We do not sell Personal Information to third parties. As described in the section "Sales and Sharing of Personal Information" above, we do process Personal Information for the purpose of displaying targeted advertisements, if you instruct us to do so. You have the right to opt out of the processing of Personal Information for targeted advertising purposes. You may modify your cookies choices at any time by clicking the ‘Cookies Settings’ link in the footer of our website. 

Please note that the rights described above are not absolute, and where an exception under applicable law applies, we may be entitled to refuse requests in whole or in part. Virginia Privacy Rights

The Virginia Consumer Data Protection Act defines "consumer" as a Virginia resident who is acting in an individual or household context only and does not include residents acting in a commercial or employment context.

If you are a Virginia consumer, you may have the following rights concerning your Personal Information, subject to certain limitations and exceptions under applicable law:

• Access: You have the right to submit a verifiable consumer request to confirm whether or not we are processing your Personal Information and to access such Personal Information.
• Data Portability: You have the right to submit a verifiable consumer request to obtain a copy of the Personal Information you provided to us in a portable, and to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance, where the processing is carried out by automated means.
